In urging the Commission to be careful and deliberate, in examining the many issues involved, we singled out that PEG channels and programming must be protected and not suffer any unintended consequences as a result of any actions the Commission might take. NATOA, along with the National Association of Broadcasters (NAB) and the North Dakota County Cable Communications Commission (NDC4), have filed a lawsuit challenging the FCC’s recent decision to impose a nationwide finding of effective competition. The Commission’s overarching action, which flew in the face of a congressional directive to simply streamline the effective competition process for small cable providers, will result in higher consumer prices and may result in the removal of PEG and local broadcast channels from the basic tier of service.
